For every person incarcerated in a prison or jail, there are several more on probation or parole. Most people are able to successfully complete their probationary or parole periods without incident. Sometimes, however, problems arise and people find themselves facing incarceration for an alleged violation of probation or parole.

 

While a new crime has to be proven beyond a reasonable doubt, a probation violation does not. Probation can be revoked based just upon a preponderance of the evidence. While people have the right to hire an attorney to fight their probation revocation, they usually do not get court-appointed attorneys to defend them. Hundreds if not thousands of people have their probation revoked in Georgia every year without the benefit of legal representation.
